We will store the details that you provide to us when registering on this website in order to verify your identity whenever you re-visit the website.

Changing these terms

NESS reserves the right to change the terms under which this website is offered, by giving not less than thirty days’ notice on the website.

Fees and transaction charges

NESS does not charge any fee to persons who participate in the online donation service. The only fees applicable to donation transactions are those charged by SagePay and the card issuers.

Unauthorised card use

When a donation is made the transaction is final and not disputable unless unauthorised use of your payment card is proved. If you become aware of fraudulent use of your card, or it is lost or stolen, you must notify your card provider in accordance with its reporting rules.

Security Policy

Full card details are not stored by NESS on our servers. However, card details are stored by our payment provider SagePay for the purposes of processing your donation. Information that is stored by NESS about individual donations is not made available to other organisations or companies use in aggregate form that is not personally identifiable for analysis.

Refund Policy

Donations will only be refunded if the refund complies with the Charities and Trustee Investment (Scotland) Act 2005 and is at the discretion of NESS.

Please contact us within 28 days of making your donation if you would like to claim a refund.


This agreement is governed by Scots Law. By accessing this website, you submit to the nonexclusive jurisdiction of the Scottish Courts. Use of this website is unauthorised in any jurisdiction that does not give effect to all provisions of these terms.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and NESS as a result of the agreement constituted by these terms or use of this website.

NESS’s performance of the agreement constituted by these terms is subject to existing laws, and nothing in these terms derogates NESS’ right to comply with governmental, court and law enforcement requests or requirements NESS with respect to that use. If any part of this agreement is determined to be invalid or unenforceable under applicable law including, but not limited to, the warranty disclaimers and liability limitations, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the term shall continue in effect.

This agreement constitutes the entire agreement between the user and NESS, with respect to this website, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and NESS with respect to this website. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
